These Terms of Service (“Terms”) govern your access to and use of the Texas Entertainer of the Year website (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

The Site provides information about Texas Entertainer of the Year, including event details, schedules, announcements, downloadable materials, photos/videos, and links to third-party services such as ticketing and (in the future) merchandise.

You must be at least 13 years old to use the Site. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Site.

We may modify the Site or these Terms at any time. Changes are effective when posted. Your continued use of the Site after changes are posted means you accept the updated Terms.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information.

Ticket purchases and any related terms (including refunds, chargebacks, and disputes) are governed by the third-party ticketing provider’s terms and policies at the time of purchase.

Event dates, times, venues, lineups, and program details may change. While we try to keep information accurate, we do not guarantee that all Site content is always current or error-free.

The Site may display photos and videos from events and promotions. Any contestant-specific permissions, releases, and media terms are handled through the official contestant packet and related documents provided to contestants.

If you are not a contestant and believe media on the Site should be removed for a legitimate reason, you may contact us with:

• A link to the content
• The reason for the request
  We will review and respond in a reasonable timeframe.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZUE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZUE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

IN NO EVENT WILL ZUE’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE EXCEED $100 OR THE AMOUNT YOU PAID TO ZUE THROUGH THE SITE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

You agree to defend, indemnify, and hold harmless ZUE and its affiliates, officers, directors, employees, volunteers, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or related to:

• Your use of the Site
• Your violation of these Terms
• Your submission of content that violates law or infringes a third party’s rights

We may suspend or terminate your access to the Site at any time if we believe you violated these Terms or used the Site unlawfully or improperly.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Site will be brought in state or federal courts located in Dallas County, Texas, and you consent to that jurisdiction and venue.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy and any other posted policies, constitute the entire agreement between you and ZUE regarding the Site.
